Terms & Conditions

These terms apply to all aerial videography services booked with BAY 360 (ABN 53 489 866 550), based in Jervis Bay, NSW. By booking a shoot, you agree to the terms below.

Bookings & payment

A booking is confirmed once details are agreed and, where requested, a deposit is paid. Full payment is due on delivery of final footage unless otherwise agreed in writing.

Weather & rescheduling

Aerial shoots depend on safe flying conditions. If high winds, rain, or low visibility make flying unsafe on the day, your session will be rescheduled at no extra cost — see the Flight Compliance section for details.

Client responsibilities

Clients are responsible for providing accurate shoot details (location, access, and any site-specific restrictions) and for obtaining permission to fly over private property where required. Where a shoot involves a venue, landowner, or crowd, any additional authorisation is arranged as part of planning — see Safety & Regulations.

Flight authorisation & compliance

All flights are conducted in accordance with CASA (Civil Aviation Safety Authority) regulations. BAY 360 reserves the right to decline or postpone a flight on safety or regulatory grounds, including airspace restrictions, wildlife, or crowd density.

Model releases & usage rights

Depending on the nature of the shoot, a model release or content usage agreement may be required from clients or featured individuals prior to filming. This confirms how footage may be used, including whether it may appear in BAY 360's portfolio or promotional materials.

Intellectual property

BAY 360 retains copyright over all footage captured. Delivered final footage is licensed to the client for their own personal or business use. Any broader licensing or resale should be agreed in writing beforehand.

Liability

BAY 360 carries public liability insurance and takes all reasonable care in planning and conducting every flight. To the extent permitted by law, BAY 360 is not liable for indirect or consequential loss arising from a shoot, including loss caused by weather, equipment failure, or circumstances outside our reasonable control.

Governing law

These terms are governed by the laws of New South Wales, Australia.
